Panel Tosses Nationwide Freeze on Trump’s Public Charge Rule

A nationwide injunction blocking a Trump administration rule that denies legal status to immigrants receiving public assistance was stayed by a Second Circuit panel.

The Southern District of New York found the rule “impedes public efforts” to stem the spread of Covid-19 by deterring non-citizens from getting tested or seeking treatment.

But the court likely lacked jurisdiction to enter the injunction while the appeal of its previously-issued injunction was pending, the U.S. Court of Appeals for the Second Circuit said Sept. 11.

The ruling allows the Department of Homeland Security to implement its rule issued in February 2020.
