Extension of Public Comment Period and Public Hearing on the Russo Warehouse Harrison Amendment Proposal to the Tri-County Water Quality Management Plan
A public notice regarding a public comment period extension and public hearing for a Proposed Amendment to the Tri-County Water Quality Management Plan will be published on April 1, 2024, in the NJR. The January 16, 2024, publication of the NJR (56 N.J.R. 156(a)) contained preliminary notice regarding the proposed “Russo Warehouse Harrison,” also known as “Swedesboro Warehousing,” (Program Interest No. 435433, Activity No. AMD220001) amendment in Harrison Township, Gloucester County. A public hearing will be held on June 4, 2024, at 10:00 AM via Microsoft Teams. The hearing will conclude at 12:00 PM or the conclusion of all public testimony, whichever is earlier. For those without access to web meetings, the hearing will also be accessible by phone for audio only. The January 16, 2024, publication of the NJR (56 N.J.R. 155(a)) contained preliminary notice regarding the proposed “Diamond Chip Logistics Park” (Program Interest No. 435459, Activity No. AMD220001) amendment in Sparta Township, Sussex County. Proposed Amendment to the Cape May County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to Cape May County Water Quality Management (WQM) Plan will be published on March 18, 2024, in the New Jersey Register. The proposed amendment, identified as “Clermont Lodge Resort” (Program Interest No.435464, Activity No.230001) would redesignate 30.8 acres of currently adopted sewer service area (SSA) as SSA of a proposed onsite Discharge to Groundwater wastewater treatment system to serve a proposed resort on Block 262, Lots 15 & 16, Dennis Township, Cape May County. As calculated in accordance with N.J.A.C. 7:14A-23.3, the proposed project will generate a projected wastewater flow of 28,676 gallons per day (gpd).

Proposed Amendment to the Tri- County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to Tri-County Water Quality Management (WQM) Plan will be published on March 4, 2024, in the New Jersey Register. The proposed amendment, identified as “422 Swedesboro Avenue Warehouse” (Program Interest No. 435433 Activity No. AMD230002) would expand the sewer service area (SSA) of the Gloucester County Utilities Authority Sewage Treatment Plant (STP) (NJPDES No. NJ0024686) by 9.91 acres to serve a proposed 138,000 square foot (SF) warehouse development with 69 employees in each of three shifts (207 total), located on a portion of Block 201, Lot 22, in East Greenwich Township, GloucesterCounty. The project will generate a projected wastewater flow of 5,175 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Northeast Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Northeast Water Quality Management (WQM) Plan will be published on February 20, 2024, in the New Jersey Register. The proposed amendment, identified as “Collins Brook Estates” (Program Interest No.435442, Activity No. AMD230003) would expand the sewer service area (SSA) of the Livingston Water Pollution Control Facility (WPCF) (NJPDES No. NJ0024511) by 0.51 acres to serve a mixed-use residential development located on a portion of Block 2700, Lots 62 and 63, in Livingston Township, Essex County. Most of the 1.791-acre project site is located with the currently adopted SSA. The two existing homes on the site will be removed and replaced with 32 two- and three- bedroom townhouse/apartment units. Two three-bedroom and one two-bedroom apartment and 2 three-bedroom and 4 two-bedroom townhouses are located outside of the currently adopted SSA. The portion of the proposed project located outside of the SSA will generate 2,325 gallons per day (gpd) of the total 8,025 gpd based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Tri-County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to Tri-County Water Quality Management (WQM) Plan will be published on February 20, 2024, in the New Jersey Register. The proposed amendment, identified as “Mount Laurel Animal Hospital Expansion” (Program Interest No. 435433, Activity No. AMD230003) would expand the sewer service area (SSA) of the Mount Laurel Municipal Utilities Authority (MLMUA) Hartford Road Sewage Treatment Plant (STP) (NJPDES No. NJ0025178) by 1.47 acres to serve an expansion of the existing Mount Laurel Animal Hospital located on Block 508, Lot 2, in Mount Laurel Township, Burlington County. The project will generate a projected wastewater flow of 1,155 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Monmouth and Ocean County Water Quality Management Plans
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Monmouth County Water Quality Management (WQM) Plan will be published on February 20, 2024, in the New Jersey Register. The proposed amendment, identified as “Charleston Meadows” (Program Interest No. 435462, Activity No. AMD230005) would expand the Ocean County Utilities Authority Northern Water Pollution Control Facility (OCUA Northern WPCF) sewer service area (SSA) by 7.3 acres to serve a proposed townhouse/condominium development on Block 42, Lot 4 (portion), in Colts Neck Township, Monmouth County. The proposed project includes 56 three-bedroom units and 12 two-bedroom units. The proposed project would generate a projected wastewater flow of 19,500 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3 to be received by the OCUA Northern WPCF (New Jersey Pollutant Discharge Elimination System (NJPDES) Permit #NJ0028142). The wastewater would be conveyed to the OCUA Northern WPCF via the Manasquan River Regional Sewerage Authority (MRRSA) owned and operated infrastructure system.

Proposed Amendment to the Atlantic County, Cape May County, Lower Delaware, Lower Raritan/Middlesex County, Mercer County, Monmouth County, Northeast, Ocean County, Sussex County, Tri-County, Upper Delaware, and Upper Raritan Water Quality Management Plans
In accordance with Water Quality Management Planning rules at N.J.A.C. 7:15, a public notice for a Proposed Amendment to the to the Atlantic County, Cape May County, Lower Delaware, Lower Raritan/Middlesex County, Mercer County, Monmouth County, Northeast, Ocean County, Sussex County, Tri-County, Upper Delaware, and Upper Raritan Water Quality Management Plans will be published on February 5, 2024, in the New Jersey Register. The proposed amendment, identified as “303(d) List of Water Quality Limited Waters”, describing the health of the State’s waters by determining whether these waters are meeting surface water quality standards and supporting uses. States are also required to develop a list of waters that currently do not meet, or are not expected to meet, applicable water quality standards after the implementation of technology-based controls. This list is known as the 303(d) List of Water Quality Limited Waters or “303(d) List.” The 303(d) List includes a priority ranking for a state’s development of Total Maximum Daily Loads (TMDLs). Proposed Amendment to the Tri-County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Tri-County Water Quality Management (WQM) Plan will be published on January 16, 2024, in the New Jersey Register. The proposed amendment, identified as “Sykesville North Hanover” (Program Interest No.435433, Activity No.220005) would establish a sewer service area (SSA) for a new NJPDES permitted discharge to groundwater (DGW) facility located on 56.52 acres on Block 602, Lot 9.02, in North Hanover Township, Burlington County. The project is for 917,050 square feet (sf) of warehouse space within five buildings and 50,000 (sf) of associated office space. The proposed wastewater flow, based on 3 shifts is 16,180 gallons per day (gpd), based on flow calculated in accordance with N.J.A.C. 7:9A.

Proposed Amendment to the Tri-County County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Tri- County Water Quality Management (WQM) Plan will be published on January 16, 2024, in the New Jersey Register. The proposed amendment, identified as “Russo Warehouse Harrison,” also known as “Swedesboro Warehousing,” (Program Interest No.435433, Activity No.220001) would expand the sewer service area (SSA) of Gloucester County Utilities Authority (NJPDES No. NJ0024686) by 73.07 acres to serve portions of 2 of 4 proposed warehouse buildings with associated office space on Block 46, Lot 2 and Block 47, Lots 1, 2, 3, 3.01 and 4, in Harrison Township, Gloucester County. The remaining 87.25 acres of the project site are located within the currently approved SSA of the GCUA STP within Woolwich Township. The overall project is for four proposed warehouses, one that includes food processing, and associated office space in each. Buildings A and C straddle the municipal border, being partially within the currently approved SSA within Woolwich Township and partially outside of the SSA within Harrison Township. Building A will be 933,610 square feet (sf) food processing space and 29,706 sf office space and Building C will be 295,714 sf of warehouse space and 16,603 sf of office space. Buildings B and D are within the currently approved SSA in Woolwich Township and are not the subject of this amendment. The entire project would generate a projected wastewater flow of 136,000 gallons per day (gpd), with 105,894 gpd of the total associated with Buildings A and C. The wastewater is to be received by the GCUA STP, New Jersey Pollution Discharge Elimination System (NJPDES) Permit No. NJ0024686, via the Woolwich Township Regional Wastewater and Conveyance System, based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Sussex Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Sussex Water Quality Management (WQM) Plan will be published on January 16, 2024, in the New Jersey Register. The proposed amendment, identified as the “Diamond Chip Logistics Park” (Program Interest No. 435459, Activity No. AMD220001) is proposing two warehouse buildings totaling 698,000 square feet (sq. ft.), which includes 10,000 sq. ft. of office space, for three shifts of 185 warehouse employees per shift, and 85 delivery personnel per day on 48.98 acres of a 69.47-acre parcel, located on Block 12008, Lot 23 in Sparta Township, Sussex County. The project will generate a projected wastewater flow of 10,000 gallons per day (gpd) based on flow calculated in accordance with 7:9A-7.4. The proposed onsite DGW wastewater treatment system will be regulated under a new New Jersey Pollutant Discharge Elimination System (NJPDES) permit. The amendment will also remove 20.49 acres from the currently adopted sewer service area. The site is currently occupied by Sparta Sand and Gravel, which operates under NJPDES permit NJ0098621. This permit will be revoked.

Proposed Amendment to the Mercer County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Mercer County Water Quality Management (WQM) Plan will be published on January 16, 2024, in the New Jersey Register. The proposed amendment, identified as “Moore Residence – 106 Hopewell Rocky Hill Road” (Program Interest No. 435452, Activity No. AMD210004) would expand the sewer service area (SSA) of the Stony Brook Regional Sewerage Authority (SBRSA) Hopewell Sewage Treatment Plant (NJPDES No. NJ0035301) by 0.04 acres to serve an existing single family home located on Block 8, Lot 66, in Hopewell Township, Mercer County. The home is currently served by an onsite system which will be abandoned and closed upon connection to the sewer. The project will generate a projected wastewater flow of 300 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3. This is a re-notice of a proposal originally published in the 9/5/2023 NJR at 55 N.J.R. 1964(a).

The proposed amendment, identified as “Kelly Farm Logistics North” (Program Interest No.435441, Activity No.220004) would expand the sewer service area (SSA) of the Carneys Point Township Sewerage Authority Sewage Treatment Plant (STP) (NJPDES No. NJ0021601) by 103 acres to serve a proposed development that includes the construction of four warehouse buildings with a total footprint of approximately 2,048,000 square feet located on portions of Block 239, Lots 14, 15, 16, 17, 17.01, 17.02, and 19, in Carneys Point Township, Salem County. The total proposed area of disturbance is 245 acres, 10 acres of which are in the currently adopted SSA and 103 acres which are proposed to be added to the SSA. The project will generate a projected wastewater flow of 51,900 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

Proposed Amendment to the Mercer County Water Quality Management Plan – Public Hearing Cancellation
The September 5, 2023 publication of the New Jersey Register, the Water Quality Management Planning Program Public Notices webpage and a Listserve announcement contained a preliminary notice regarding the proposed Moore Residence – 106 Hopewell Rocky Hill Road amendment. The notice included details on a public hearing scheduled to be held at the McDade Administration Building, 640 South Broad Street, Freeholder Meeting Room 211, Trenton, NJ 08650-0068 on Wednesday, October 11, 2023, at 9:00AM to allow for public comment on the proposed amendment. This is to inform all interested parties that the public hearing scheduled for October 11, 2023 has been cancelled. A new public notice with a revised date and time for the public hearing will be published in a subsequent volume of the New Jersey Register. |

Proposed Amendment to the Ocean County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Ocean County Water Quality Management (WQM) Plan will be published on September 5, 2023, in the New Jersey Register. The proposed amendment, identified as Ocean County Parks and Recreation Administration Building (Program Interest No. 435448, Activity No. AMD220007), would expand the expand the sewer service area (SSA) of the Ocean County Utilities Authority Central Wastewater Pollution Control Facility (OCUA Central WPCF) by 0.30 acres to serve the existing Ocean County Parks and Recreation Administration office building on Block 444, Lot 71 (portion), in Toms River Township, Ocean County. The existing 8,000 square foot building is presently served by three septic systems. The existing septic systems will be closed and the wastewater conveyed to the OCUA Central WPCF (New Jersey Pollutant Discharge Elimination System (NJPDES) Permit #NJ0029408). The proposed project would generate a projected wastewater flow of 800 gallons per day (gpd) based on flow calculated in accordance with N.J.A.C. 7:14A-23.3.

The proposed amendment, identified as “122-128 Hope Chapel Road/Hope Road LLC” also known as “Schindler Court” (Program Interest No. 435448, Activity No. AMD220005), would expand the Ocean County Utilities Authority Northern Water Pollution Control Facility (OCUA Northern WPCF) sewer service area (SSA) by 1.04 acres to include one (1) existing 6-bedroom single-family dwelling and two (2) proposed 6-bedroom single-family dwellings located on Block 13601, Lots 9 (portion) and 10 (portion), in Jackson Township, Ocean County. An existing single-family home located on Lot 9 will be demolished. The amendment area is a portion of a proposed subdivision (Schindler Court) that includes four additional single-family home lots located in the currently adopted SSA in Lakewood Township, and which are not the subject of this amendment. The proposed project consists of four 4-bedroom single family homes. VIRTUAL PUBLIC HEARING
Public Hearing on the Lincoln Logistics Franklin – Upper Delaware WQMP Amendment Proposal
On June 5, 2023, the Bureau of NJPDES Stormwater Permitting and Water Quality Management published a public hearing announcement for the Lincoln Logistics Franklin amendment to the Upper Delaware Water Quality Management Plan in the New Jersey Register (55 N.J.R. 324(a)). The public hearing is scheduled for 2:00 pm on July 12, 2023, and will be conducted virtually via Microsoft Teams. The hearing will remain open until 4:00 pm or the conclusion of all public testimony, whichever is earlier.

Prior to entering the hearing, participants are strongly encouraged to read the following information and guidelines:

- If an attendee to the public hearing would like to provide testimony, they are encouraged, but not required, to notify the WQMP program via the wqmp.publiccomments@dep.nj.gov email address or by calling 609-633-7021. Make sure to include full name, the name of the organization that you represent, phone number and email as applicable. When called upon for testimony, participants will be asked to re-state their full name and the name of the organization that they represent.
- Access to the public hearing is available on your computer or mobile device through either the Microsoft Teams application or the device’s web browser.
- The web browsers that best support Microsoft Teams meetings are Internet Explorer 11, Microsoft Edge, Chrome, and Firefox.
- The hearing will begin promptly at the designated starting time of 2:00 pm.
- The hearing will be moderated by a NJDEP representative.

The proposed amendment, identified as “St. Mary’s Commercial Center” (Program Interest No. 435448, Activity No. AMD200007) would expand the sewer service area (SSA) of the Ocean County Utilities Authority Central Wastewater Pollution Control Facility (OCUA Central WPCF) by 8.1 acres to serve a proposed commercial development located on Block 145 Lot 6.03 (formerly a portion of Lot 9) within Toms River Township, Ocean County. The proposed project consists of a 14,800 square foot (sq. ft.) drugstore, a 75-seat fast food restaurant, a 3,800 sq. ft. bank, and a 12,000 sq. ft. retail store/office. On July 5th, 2022, the Bureau of NJPDES Stormwater Permitting and Water Quality Management published a public hearing announcement for the White - 519 Commerce Center amendment to the Upper Delaware Water Quality Management Plan in the New Jersey Register (54 N.J.R. 787(a)). The public hearing is scheduled for 10:00 am on August 5th, 2022, and will be conducted virtually via Microsoft Teams. The hearing will remain open until 12:00 pm or the conclusion of all public testimony, whichever is earlier.

Proposed Amendment to the Sussex County Water Quality Management Plan
In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Sussex County Water Quality Management (WQM) Plan will be published on February 7, 2022, in the New Jersey Register. The proposed amendment, identified as “Milly’s Court” (Program Interest No. 435459, Activity No. AMD170002) would expand the sewer service area (SSA) of the Sussex County Municipal Utilities Authority’s Upper Wallkill Valley Water Control Facility (SCMUA UWVWCF) by 7.59 acres to serve a proposed residential development located on Block 2701, Lot 2 (portion) in Franklin Borough, Sussex County. Four and three quarters acres of presently adopted sewer service area that is located on the property is proposed to be removed by this amendment. The proposed amendment portion of the project consists of 91 one-bedroom apartments, 105 two-bedroom apartments, and 28 three-bedroom apartments. The entire proposed project also includes 21 additional one-bedroom apartments, 15 additional two-bedroom apartments, and a clubhouse and pool, however, these buildings are located within the presently adopted sewer service area and therefore, are not the subject of this amendment. The proposed amendment portion of the project would generate a projected wastewater flow of 45,675 gallons per day (gpd), as calculated in accordance with N.J.A.C. 7:14A-23.3, to be received by the SCMUA UWVWCF (New Jersey Pollutant Discharge Elimination System (NJPDES) permit #NJ0053350).

In accordance with the Water Quality Management Planning rules, N.J.A.C. 7:15, a public notice for a Proposed Amendment to the Tri-County Water Quality Management (WQM) Plan will be published on June 7, 2021 in the New Jersey Register. The proposed amendment, identified as the “Deptford Redevelopment Area-Proposed Warehouse “(Program Interest No. 435433, Activity No.AMD200002) would expand the sewer service area (SSA) of the Gloucester County Utilities Authority (GCUA) Sewage Treatment Plant (STP), NJPDES No. NJ0024868, by 2.8 acres on portions of Block 387.01; Lots, 33, 36 & 50, in Deptford Township, Gloucester County. The proposed project site is 143 acres of which approximately 92 acres are currently designated as SSA of the GCUA STP. The expanded SSA would allow for the proposed development consisting of the construction of two warehouses, 1,200 square feet (sf) and 150,215 sf in size, and a 8,000 sf retail building. The project will generate a projected wastewater flow of 19,550 gallons per day (gpd) as calculated in accordance with N.J.A.C. 7:14A-23.3.

Notice of Extension of Comment Period for Proposed Amendments Published April 6, 2020
The comment period on four proposed Water Quality Management Plan amendments has been extended. The public notices of the proposed amendments were published in the April 6, 2020 New Jersey Register identifying a 30-day public comment period. Subsequent to the filing of these notices for publication, by Executive Order No. 103, dated March 9, 2020 (EO 103), Governor Phil Murphy declared that a Public Health Emergency and State of Emergency exists in the State of New Jersey as a result of COVID-19. In light of the disruption caused by the COVID-19 virus, the public comment periods for each of these proposed amendments is extended to 60 days. The affected amendments are: Cape May County WQM Plan - Ocean Isle Campground; Lower Delaware WQM Plan - Galetto SSA; Northeast WQM Plan - Guru Nanak, Inc.; Northeast WQM Plan – Mine Hill WMP Chapter.

A preliminary notice was published in the New Jersey Register on September 03, 2019, at 51 N.J.R. 1435(a) seeking public comment on the proposed amendment (Program Interest No. 435437, Activity No. AMD170002), identified as “Haberman Hampton.” The proposed amendment would establish a new on-site wastewater treatment plant that discharges to ground water and a new sewer service area of 47 acres to serve a proposed development consisting of 142 single-family homes, 146 multi-family attached units, and 45 multi-family attached affordable units, and 6,000 square feet of commercial space, on a portion of Block 23, Lot 1 in Hampton Borough, Hunterdon County. The proposed project would generate a projected wastewater flow of 86,175 gallons per day to be received by the new subsurface sewage disposal system. A non-adversarial public hearing will be held from 5:00 – 7:00 PM on Tuesday January 21, 2020, at the Hunterdon County Administration Route 12 County Complex, NJ-12, Flemington, NJ 08822. The public comment period is extended to February 3, 2020.
